The terms of sale apply to all goods supplied by SND hereon referred to as the ‘Supplier’.
No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full .
The contract is subject to your right of cancellation (see below).
The description of the goods you order will be as shown on the Supplier’s website at the time you place your order.
We list all of our products as accurately as possible, but with so many different products and manufacturers subtly upgrading their products throughout the year, there may be a few occasions when what you receive is not 100% as described (but the difference will always be minimal and beyond our control). On such occasions where you are unhappy with your item you have received, we will always accept the return of the goods, refund your payment in full and update the listing accordingly.
The dimensions we quote are based on the information provided to us by the manufacturers but on rare occasions these can be inaccurate (particularly if the fitting has been remodelled) and so we recommend that you do not cut holes etc until you are in receipt of the lights and have physically checked the dimensions. Please note that we do not accept any costs related to failure to install
If you require any additional information before ordering to confirm suitability please contact the Supplier in advance.
All goods are subject to availability. If the Supplier anticipates an unreasonable delay with the delivery of your order then the Supplier will contact you as soon as possible to offer a refund for any sum that has been paid by you for the goods.
Every effort is made to ensure that prices shown on the Supplier’s website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If the Supplier does not receive a response within 5 days of informing you of the error, the order will be cancelled automatically. If you cancel for this reason, the Supplier will refund or re-credit you for any sum that has been paid by you.
Payment, inclusive of delivery charges, must be made in full before an order can be released for delivery.
Payments shall be made by you without any deduction unless agreed in advance by the Supplier to you and processed via a valid discount voucher.
Cancellation and Returns Policy
An order can be cancelled in writing within 7 working days of delivery. Please ensure items are retuned in original box(s) including original packaging, unused and in a resalable condition, including all lamps/bulbs.A refund shall be provided less the costs of carriage/postage.
Please note if goods are being returned, then you are responsible for the return postage costs. The return must be confirmed within 14 days of recieving your item. Unwanted items must be securely packed and returned via a courier which offers a tracked service. Please also ensure that, if necessary, extra insurance is paid for to cover the value of the unwanted/returned goods. The Supplier does not take any responsibility for lost or damaged items that are returned by you.
This returns policy does not apply to goods that have been manufactured/tailor made specifically for you, e.g. specially manufactured crystal chandeliers or other specially modified electrical goods cannot be returned for a refund.
A cancellation email must be sent in writing, to us at email@example.com within 14 days of recieving your item. Notification by telephone is not acceptable. On receipt of your cancellation email, a returns reference will be provided. This reference must be quoted in all calls and emails to the Supplier.
If you cancel your order after the goods have been dispatched, a refund will only be provided once your cancelled order has been returned back to us at our warehouse or at our supplier’s warehouse.
Goods that are returned to SND will be inspected for any sign of use, damage, misuse or neglect and we will refund you within 30 days for any sum that has been paid by you less the costs of carriage/postage. If there is any doubt on the condition of the goods, the Supplier reserves the right not to exchange or give a refund.
We have the right to refuse refunds for failure to meet the above criteria.
Damaged Goods & Shortages
If the goods supplied to you are damaged on delivery or if there any shortages, you should notify the Supplier in writing via e-mail: firstname.lastname@example.org within 48 hours. It is your responsibility to thoroughly check all goods for damages & shortages within 48 hours. Outside this time, no claims will be accepted and any replacements will be chargeable to you.
The Supplier will not be liable for any costs incurred due to delayed delivery, faulty goods or shortages such as electrician’s, contractor fees etc.
Faulty or damaged goods will be replaced or refunded in full in accordance with the Distance Selling Regulations of 2000.
Damaged or Broken glass does not constitute faulty goods.
Please note that all fittings that are sold complete with lamps or tubes are on the basis that the lamps and tubes are supplied free of charge and are therefore excluded from warranty or damaged on delivery replacement. Due to the very delicate nature of these products we are unable to supply replacements free of charge.
Any installation / fitting of non portable lighting purchased from SND Lighting must be carried out by a qualified electrician.
Failure to have non-portable lighting installed / fitted by a qualified electrician will invalidate your warranty and may be in breach of the current building regulations.
All goods supplied warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
The warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier’s instructions, or any alteration or repair carried out without the Supplier’s approval.
Any goods returned for a warranty claim that are found to not be faulty or the subject of misuse, which includes incorrect installation will be returned to the customer/s at their cost.
Limitation of Liability
The Supplier’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods.
Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier’s negligence or fraudulent misrepresentation.
Under no circumstances will the Supplier be held responsible for but not limited to additional electrician or any other contractor fees that arise because of but not limited to late, damaged or incorrect delivery of goods. You should not book an electrician or any other contractor in advance of delivery.
The Supplier will take all reasonable steps to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorized access to information supplied by you.
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
